基于核心专利群的专利规避范围界定方法研究

摘要: 在知识经济主导社会发展的时代,核心专利群规避已成为企业对抗竞争对手的一项策略,这一策略有助于企业在市场经济中保持竞争力.提供了一种确定核心专利群规避范围的方法,通过选取专利库并制定专利检索策略以及筛选策略检索出相关技术专利,借助向前引证分析出需要规避的核心专利群,并建立核心专利群中每件专利的系统结构树及相应的功能树,依据系统结构树及功能树提供的元件及其功能关系,建立核心专利群的模块\|功能表,由表中元件所处的模块确定规避范围;最后寻找出插头的核心专利群的规避范围,并评估该方法的优越性.

Abstract: In the era of knowledge economy leading the development of the society, patent design around for the group of core patents becomes a strategic to help business against competitors and keep competitive in the market. A method to confirm the scope of group of core patents was described. Related patents were found by selecting patent database and making patent retrieval strategy and selecting strategy. Then the group of core patents that needed to be avoided was analyzed using forward citation and the system structure trees and function trees of the group of every patent were established. Module\|function table was built according to relationship of components and their functions, then the scope of patent design around was determined via components of the modules in the table. Lastly, using plug as an example, the scope of group of core patents was found out to assess the superiority of the proposed method.
